1. Overview
This Acceptable Use Policy ("AUP") sets out the rules for using the Assayed platform. It forms part of the Terms of Service and applies to all users. Its purpose is to ensure the platform remains fair, reliable, and available for all subscribers.
2. Fair Use
Each subscription tier includes a monthly assessment allowance. This allowance is designed for normal business use by the number of users included in your plan.
- Assessments are counted per company assessed, not per report viewed or downloaded.
- Re-running an assessment on the same company within 24 hours does not consume an additional credit.
- Unused assessments do not roll over to the next billing period.
- Enterprise plans may include custom allowances as agreed in the Enterprise SLA.
If your usage consistently exceeds your plan allowance, we may recommend upgrading to a more suitable tier. We will not suspend your account for occasional overages without prior notice.
3. Prohibited Activities
You must not use the platform to:
- Automated scraping: Use bots, scripts, or automated tools to access the platform or extract data programmatically through the user interface. API access is available on Standard and Enterprise plans for programmatic use.
- Reselling assessment data: Redistribute, resell, or sublicense assessment reports or data to third parties without written permission from Cairnstone Consultancy Ltd.
- Circumventing access controls:Attempt to bypass authentication, access other users' data, or exploit vulnerabilities in the platform.
- Unlawful purposes: Use the Service for any purpose that violates applicable laws or regulations, including using assessment data for discriminatory or harassing purposes.
- Reverse engineering: Decompile, reverse engineer, or attempt to extract the source code or algorithms of the platform.
- Account sharing: Share account credentials with individuals not authorised under your subscription. Each user seat is for a named individual.
- Excessive load: Deliberately place unreasonable load on the platform infrastructure through rapid, repeated requests or bulk operations beyond your plan limits.
4. Rate Limiting
The platform enforces rate limits to ensure fair access for all users. These limits apply to all subscription tiers:
- Assessment requests: A maximum number of concurrent assessments may be enforced based on your plan tier.
- API requests: Enterprise API access is subject to rate limits specified in the Enterprise SLA.
- Page requests: Standard web browsing usage is not rate-limited. Automated or excessive page requests may be throttled.
If you encounter a rate limit, the platform will return an appropriate error message. Wait briefly and retry. If you believe the limit is too restrictive for your use case, contact support to discuss options.
5. Data Usage Restrictions
Assessment data generated through the platform is licensed for your internal business use. Specifically:
- You may share assessment reports within your organisation for procurement and due diligence purposes.
- You may include assessment findings in internal reports and procurement documentation.
- You must not publish assessment reports publicly or share them with the assessed company without their consent.
- You must not aggregate assessment data to create competing products or databases.
6. Reporting Violations
If you become aware of any violation of this policy by another user, please report it to support@assayed.co.uk. We investigate all reports and treat them confidentially.
7. Enforcement
Violations of this policy may result in the following actions, at our discretion:
- Warning: A written notice describing the violation and required corrective action.
- Temporary suspension: Suspension of account access for a specified period while the violation is investigated.
- Permanent termination: Permanent removal of account access for serious or repeated violations.
We will provide reasonable notice before taking enforcement action where possible. In cases of serious or ongoing abuse, immediate suspension may be necessary to protect other users and the platform.
